Mexican company, leader in the selling of sporting goods hired us to recover a domain name registered by a third party which reproduced one of that company’s trademarks.

Mexican company, leader in the selling of sporting goods hired us to recover a domain name registered by a third party which reproduced one of that company’s trademarks.

In order to achieve this, we obtained from the Mexican Institute of Industrial property certified copies of the Certificates of Registration of the client Trademark and carried out searches in order to determine if that third party had some prior claim to retain it. We also obtained full data concerning that third party.

Having done this, we applied online before the World Intellectual Property Organization (WIPO) for the ad hoc procedure for this type of actions, known as the “Policy for the resolution of domain name disputes for .MX" (LDRP) and served the domain name holder with a copy of our complaint.

WIPO received and gave course to our complaint under its terms. The holder of the domain name in dispute was notified and, according to this procedure, was given a fixed period to present reply and submit evidence. The holder did not respond to the complaint. WIPO immediately appointed an Expert to issue a resolution within the prescribed period. The Expert issued a resolution and ordered that the domain name in dispute be transferred to our client.
