I. If it has been issued in violation of this Law or any other law effective at the time of registration.

This right may be exercised at any time. |
II. If the Trademark is identical or similar to degree of confusion to another that has been used in the country or abroad prior to the filing date of the trademark application and applied to the same or similar products or services, provided that the person assertng prior use proves use of that trademark without interruption in the country or abroad prior to the presentation of the claim or, as the case may be, before the date of first use, as declared by the party who registered it. |
This right may be exercised within three years from publication in the Gazette. |
III. If the registration was granted based on false statements contained in the application. |
This right may be exercised within five years from effective date after publication in the Gazette. |
IV. If it was granted in error, by accident or due to differences of assessment, when another one is considered to have been violated, due to similarity to degree of confusion, applicable to identical or similar services, and |
This right may be exercised within five years from effective date after publication in the Gazette. |
V. The agent, representative, user or distributor of a trademark registered aborad , files and obtains for himself registration of a similar trademark to degree of confusion without express consent of the holder of the foreign trademark. In this case, such registration shall be considered obtained in bad faith. |
